The following disclaimers and legal notices apply to all use of CastleShields.com and to all aspects of membership in the Castle Shields voluntary, member-driven home cost-sharing community.
1. Primary Disclaimer
Castle Shields is not insurance. Castle Shields, Inc. operates a voluntary, member-driven home cost-sharing community. Membership in Castle Shields does not constitute a contract of insurance, a service contract, a warranty, or any form of risk-transfer agreement. Membership does not create any entitlement or legal right to receive payment, sharing, or any other form of financial support. All cost-sharing through Castle Shields is voluntary and never guaranteed. No member and no entity within the Castle Shields community has a legal, financial, or contractual obligation to contribute toward any other member's expenses.
2. Regulatory Compliance Notice
Castle Shields, Inc. does not engage in the business of insurance as defined under Texas Insurance Code §§ 101.051 and 101.102. Castle Shields does not act as a public adjuster or perform any adjusting function as defined under Texas Insurance Code §§ 4001.051 and 4001.101. Castle Shields does not operate as a third-party administrator as defined under Texas Insurance Code § 4151.001(1). Castle Shields is not subject to regulation under Titles 6 or 13 of the Texas Insurance Code. Castle Shields does not underwrite risk, transfer risk, assume risk, or issue any form of binding agreement to pay for losses, damages, or expenses.
3. No-Guarantee Notice
All cost-sharing through Castle Shields is voluntary. The direction of shared fund contributions toward any member's need is discretionary and subject to the availability of funds, the guidelines set forth in the Member Guide, and the sole discretion of Castle Shields. No sharing is ever guaranteed. Castle Shields and its members have no legal or financial obligation to contribute toward any member's expenses under any circumstances. Past sharing does not create a precedent, expectation, or entitlement to future sharing.
4. Not a Substitute Notice
The Castle Shields community cost-sharing program is not a substitute for homeowner's insurance, renter's insurance, property insurance, or any other form of insurance or risk-transfer product. Members are strongly encouraged to obtain and maintain appropriate insurance for their properties. Castle Shields does not replace, supplement, or serve as an alternative to any regulated insurance or risk-transfer product.
5. Member Responsibility Notice
All members remain personally and solely responsible for any and all home-related expenses, whether or not a sharing request is submitted, reviewed, or fulfilled. Membership in Castle Shields does not relieve any member of their financial responsibilities. Members should not rely on the Castle Shields shared fund as their sole or primary means of addressing home-related expenses.
6. Provider Disclaimer
Providers listed in the Castle Shields provider directory are independent professionals. Castle Shields does not employ, endorse, guarantee the work of, direct, assign, schedule, or supervise any provider. The listing of a provider in the directory does not constitute a recommendation, endorsement, or guarantee of quality, reliability, or fitness for any particular purpose. Members are solely responsible for evaluating, selecting, and engaging any provider. All agreements between members and providers are between those parties only. Castle Shields assumes no liability for the acts, omissions, work quality, pricing, or conduct of any provider, whether or not that provider is listed in the directory.
